Texas Moves To Ban Hemp Products But Approves Psychedelic Research

A Texas highway sign with marijuana leaf. gettyDisturbing news from the Lone Star state that could have harmful repercussions for the legal cannabis and hemp industry. Last night, the Texas House of Representatives passed a bill that would effectively ban federally protected hemp-derived products with THC. The legislation, known as Senate Bill 3 (SB3), would derail the state’s market, threatening more than 6,300 small businesses, 40,000 jobs, and over $4 billion in retail sales. The bill, which is expected to be signed by Governor Greg Abbott, stipulates that adults who are caught possessing hemp products with any amount of THC, could face up to a year in jail. It’s a reversal from six years ago when the Texas legislature triggered a boom in hemp-based products after greenlighting the sale of consumable hemp. Once Gov. Abbott signs off on this bill, THC products will be taken off the shelves at convenience stores, gas stations and a multitude of retailers across Texas.Lt

Vicente Llp Secures Historic Legal Settlement Authorizing Transport Of Marijuana Over State Territorial Waters

Martha's Vineyard Dispensary to Reopen as Commonwealth Reverses Position on Maritime Marijuana Shipments Between Mainland and Islands of MassachusettsBOSTON, June 24, 2024 /PRNewswire/ -- The Massachusetts Cannabis Control Commission (CCC) issued an administrative order allowing for the first-ever maritime transport of state-legal marijuana within the Commonwealth. This is part of the CCC's settlement of a lawsuit Vicente LLP filed on behalf of licensed marijuana dispensaries located on the islands of Martha's Vineyard and Nantucket. Since legalization, the CCC has maintained a policy against the transport of marijuana between mainland Massachusetts and its islands, forcing island-based dispensaries to produce their own inventory or buy it from an island cultivator.Vicente LLP filed the lawsuit on behalf of Patient Centric of Martha's Vineyard Ltd. d/b/a Island Time and The Green Lady Dispensary, Inc. against the CCC on May 21 after wholesale marijuana shortages threatened Island Time's survival as well as Martha's Vineyard's legal cannabis market at large. Nine days after Vicente LLP filed suit, the CCC voted to enter settlement negotiations with Vicente's clients to allow shipment of marijuana over intrastate waterways—a historic win for state sovereignty and marijuana access."The first-of-its-kind decision will reinvigorate the marijuana industries on Martha's Vineyard and Nantucket, opening the door to more jobs and a wider tax base for the hospitality-driven islands," said Adam Fine, Managing Partner of Vicente LLP's Boston office and co-counsel for the plaintiffs

California Senate Reintroduces Bill To Decriminalize Mushrooms

California Senate has reintroduced a bill to decriminalize mushrooms gettyThe California Senate has reintroduced a bill which, if passed, would decriminalize ayahuasca or "magic mushrooms" in the state, according to a report by the Los Angeles Times.Further, the news outlet noted that Senate Bill 58 is being backed by mental health professionals and veterans; however, the measure is expected to encounter opposition among law enforcement groups, "which have raised concerns in recent years with the possible public safety risks associated with hallucinogens."The bill was reintroduced by State Senator Scott Wiener (D-San Francisco) after an earlier version was gutted in an Assembly committee following opposition from law enforcement and a "handful of Democrats" who teamed up with Republicans against it.The bill refers only to mushrooms and not synthetic psychedelics such as LDA and MDMA (the latter better known to aficionados as "ecstasy").If passed, the bill could be a boon for the mental health community. Said Joshua Kappel, a founding partner at cannabis and psychedelic law firm Vicente Sederberg LLP: "California SB 58 is an important piece of legislation both for California and the psychedelic industry. We’ve seen a lot of research from UCLA, John Hopkins and other institutions showing the potential of psychedelic-assisted therapy in treating addiction, depression, and PTSD. As the country grapples with a mental health crisis, it’s important to have more treatment options available, and SB 58 decriminalizes natural medicines and creates a pathway for supervised therapeutic use."So far, Oregon and Colorado have legalized mushrooms while several California cities, which include San Francisco, Santa Cruz and Oakland, have already decriminalized posession of psychedelics

Connecticut To Begin Selling Adult-Use Cannabis In January

A 3d rendering of a green road sign for Connecticut gettyGood news for Connecticut: The state's legal adult-use cannabis market is rolling out on January 10, 2023. This means that licensed hybrid retailers may begin selling cannabis products to all adults 21 and over on that date.On the official launch of the operational market, DCP Commissioner Michelle H. Seagull said in a statement, “I am proud of the hard work our team has done to meet the goal of opening adult-use sales in a safe, well-regulated market. We know that many people are excited to participate in this marketplace, whether as a business or a consumer, and we encourage adults who choose to purchase and consume these products to do so responsibly once sales begin on January 10.”Highlights of the rules and regulations of the state's market include the following:*Sales will be limited to 1/4 ounce of cannabis flower, or its equivalent, per transaction when the market opens. Medical marijuana patients may purchase up to 5 ounces per month; and,*Different types and sizes of products may be purchased together up to a total of 1/4 ounce of cannabis flower or its equivalent per transaction. Here's an interesting tidbit: According to a news announcement rolling out the legal adult-use market, medical marijuana patients "are advised to purchase any necessary medication prior to January 10, or at one of the nine medical-only dispensaries in the state, as long lines and traffic are expected around the hybrid retailers during the opening weeks of adult-use sales."The impending opening of this market has some in the legal cannabis community rejoicing—but with caution. Though Michelle Bodian, counsel at leading cannabis law firm Vicente Sederberg LLP, quibbled about the limited number of hybrid retailers, she applauded the state’s ability to transition to an operational market within a brief span of time.“Even with the product limit, today is a day to celebrate,” she said
