Requirements

  • Experience with ERISA, COBRA, FMLA, the No Surprises Act, and applicable federal and state insurance laws and regulations governing welfare benefit plans and accident and health insurance.
  • Experience providing legal advice regarding group benefit and insurance solutions, third-party self-funded plan claim administration, and regulatory compliance matters.
  • Subject matter expertise in ERISA or accident and health insurance litigation or advisory work, group insurance product development or administration, stop-loss or other insurance, third-party benefit administration, or insurance and reinsurance contract drafting and negotiation.
  • J.D. degree, admission to a State Bar, and eligibility for or willingness to obtain a New Jersey Limited-License In-House Counsel license within one year of employment commencement.
  • At least 8 years of overall legal experience, including at least 3 years of relevant in-house or law firm experience specifically related to accident and health insurance products and claims management.
  • Strong personal computer skills, including Excel, Word, Outlook, and PowerPoint.
Responsibilities
  • Manage high-volume drafting, review, and negotiation of program and administrative agreements, reinsurance and retrocessionaire agreements, vendor and software-as-a-service agreements, nondisclosure agreements, and other commercial agreements while ensuring compliance with company standards, best practices, and regulatory requirements.
  • Manage contract negotiations with internal and external parties and drive the agreement delivery process, obtaining senior team review when needed.
  • Monitor contract portfolio metrics, identify process improvements, and provide strategic input on contract management systems and artificial intelligence contract review tools.
  • Develop and implement best practices for artificial intelligence-assisted contract review, mentor team members, and provide guidance and training for integrating artificial intelligence into contract management workflows.
  • Participate in template development to ensure Accident & Health contract clause requirements, risk mitigation provisions, and regulatory compliance standards are met.
  • Support claim and cost-containment audit reviews, including reviewing attorney demand letters, drafting legal responses, evaluating coverage positions, and coordinating resolution strategies with claims personnel.
  • Manage and coordinate complex claims litigation by preparing case summaries and legal analysis, leading settlement negotiations, drafting releases and settlement agreements, coordinating with outside counsel, and providing strategic litigation guidance.
  • Provide practical legal counsel to internal business units while balancing business objectives, risk mitigation, and regulatory compliance.
  • Advise on group benefit and insurance solutions, third-party self-funded plan claim administration, and regulatory compliance matters, and identify solutions that protect the Company's interests while supporting business goals.
  • Lead and participate in special projects, process-improvement initiatives, policy development, and cross-functional business initiatives requiring legal expertise.
  • Provide direct supervisory oversight of legal interns and administrative staff, including assigning and prioritizing work, managing and evaluating performance, guiding professional development, and managing workflow and deliverables.
  • Develop and deliver training programs and materials on legal topics and processes for legal department staff, underwriting teams, claims personnel, and other business disciplines.
  • Represent the Company at relevant industry trade associations and professional organizations related to Accident and Health insurance, reinsurance, and insurance law.
