Ferrellgas swings to $11.54 loss per unit as $24.7M casualty settlement pressures Q3 earnings

Ferrellgas Partners reported a fiscal third-quarter loss of $11.54 per Class A Unit, reversing earnings of $1.26 per unit from the prior year, as one-off costs pressured results. Revenue fell 6% to $524.6 million as propane volumes declined 1% amid warm weather conditions. Despite lower revenue, gross profit rose 1% to $291.4 million, driven by reduced propane supply costs. However, operating expenses surged by approximately $29 million, with $24.7 million attributed to legacy casualty claim settlements that management described as unusual and non-recurring. Net earnings attributable to Ferrellgas fell by $31.1 million to $28 million, whilst adjusted EBITDA declined 11% to $102.1 million. The company completed conversion of all Class B Units into Class A Units during the quarter.

Posted June 1, 2026 Liberty-based Ferrellgas Partners LP announced the appointment of Andrew Safran to its Board of Directors and several updates to the Board's team and operations. Safran joined the Board effective May 21. He brings more than three decades of investment banking and private equity experience, with a deep specialization in natural resources and energy infrastructure, according to a release. In addition, Ferrellgas also announced that Pamela Breuckmann has been appointed vice chair of the Board, effective May 22. Breuckmann has also served as the president and CEO of Ferrell Capital, Inc. - a subsidiary of Ferrellgas Partners LP - since 2007. Chairman of the Board, Jim Ferrell, will continue in his role. He assumed leadership of the company in 1965. "We have strengthened our balance sheet, simplified our structure, and enhanced our leadership. Andrew brings decades of leadership experience across the energy, infrastructure, and financial sectors, and we are pleased to welcome him to the Board. Ferrellgas, Inc., No. 23-10019 (5th Cir. 2024), the role of the Safety Expert Witness was central to a high-stakes propane products liability dispute. The court's Daubert analysis ultimately reversed a substantial jury verdict, illustrating how strict the appellate scrutiny of safety expert testimony has become. Background and Parties The plaintiffs were injured in a propane flash-fire incident in Texas and brought a products liability suit against Ferrellgas, Inc., a major propane distributor. Plaintiffs alleged that a 20-pound propane tank delivered by Ferrellgas had a defective face-seal at the valve interface, allowing propane to escape and ignite. The case proceeded to a jury trial in the Northern District of Texas, which returned a $1.7 million verdict in favor of the plaintiffs. Role and Methods of the Safety Expert Witness Plaintiffs retained Scott Buske, a propane safety expert, to opine on the alleged face-seal defect and the foreseeability of flash-fire ignition. Speculative causation theories - even when based on industry experience - will not survive appellate scrutiny. This case stands as a cautionary precedent for plaintiffs in propane and industrial-safety litigation: a Safety Expert Witness must be prepared to demonstrate, with specific evidence, that the alleged defect was present when the product left the defendant's control. Without that link, even compelling jury verdicts can be reversed on Daubert grounds.
