Requirements
  • Be a union member in good standing.
  • Be able to read and write.
  • Be at least 18 years old, or 21 years old if operating company-provided vehicles.
  • Be able to lift and carry up to 50 pounds.
  • Possess stamina and be able to work outdoors in various weather conditions, including extreme heat and cold.
  • Be able to safely operate landscaping equipment such as mowers, trimmers, blowers, and edgers.
  • Be able to bend, stoop, kneel, twist, stand, and walk continuously throughout the day and perform repetitive motions for extended periods.
  • Be able to perform manual labor using hand tools such as shovels and rakes.
  • Be able to wear required personal protective equipment, including safety shoes, high-visibility clothing, hand protection, eye protection, hearing protection, and head protection.
  • Have a valid driver's license and meet company motor-vehicle-performance standards if operating a BrightView fleet vehicle.
  • Be able to work flexible hours, including weekends or holidays when needed.
  • Maintain required medications for known allergic reactions in one's possession at all times.
  • Be able to work outdoors or indoors in moderate to extreme weather conditions.
  • Be able to work in direct sunlight for extended periods.
  • Be able to work near automotive traffic, bodies of water, fumes, dust, and mechanical or electrical hazards.
  • Be able to work in environments with extended periods of loud noise.
  • Be able to work around allergens, insects, and reptiles.
Responsibilities
  • Learn and develop laborer skills under the tutelage of the assigned foreman.
  • Use hand and power tools or equipment to perform landscape and irrigation duties.
  • Install irrigation and various planting materials.
  • Safeguard assets from theft and misuse.

Mitchell C. Motu prevails in a high-stakes premises liability claim for Brightview. Its team represented Brightview Landscaping in a catastrophic injury case arising from alleged sidewalk upheaval attributed to tree roots. Plaintiff presented a high eight-figure demand for a paraplegic injury, positioning Brightview as a primary target in a complex premises liability and public entity risk environment. Challenge Plaintiff sought a high eight-figure recovery and alleged that Brightview's maintenance activities caused or contributed to a dangerous condition of public property. Multiple parties faced potential joint exposure, including the City. The immediate objective was to neutralize liability theories directed at Brightview, preserve indemnity and apportionment defenses, and reallocate risk to the responsible public entity while positioning the matter for an efficient resolution. Strategy Trachtman Law Group executed a focused discovery plan centered on targeted Person Most Knowledgeable (PMK) depositions, supported by exhaustive document review. Trachtman Law Group ultimately uncovered damaging text messages, photographs, and work orders implicating that Brightview's scope of work did not include inspection or management of tree roots or sidewalks. Execution Through carefully sequenced PMK depositions and intensive preparation, Trachtman Law Group secured critical admissions regarding: (a) the City's exclusive control over sidewalk design, repair, and hazard abatement; (b) the City's notice and knowledge of root-related uplift conditions in the relevant area; (c) limitations on Brightview's obligations to inspect, alter or repair hardscape conditions; and (d) the allocation of responsibility embedded in municipal policies and maintenance directives. These admissions undercut claims centered on Brightview's alleged control and created substantial settlement pressure on the City. Result Leveraging these admissions and its premises liability expertise, Trachtman Law Group resolved Brightview's participation for $200,000, while shifting the vast majority of risk to the City for the remainder of the eight-figure settlement. This outcome protected its client's interests and avoided protracted trial risk and expense in a catastrophic-injury matter.
