Requirements
- Juris Doctor degree from an American Bar Association-accredited law school.
- Admission to practice law in South Carolina, or eligibility to practice in South Carolina within twelve months.
- Knowledge of federal and state healthcare laws, regulations, and codes.
- Proficiency in drafting, negotiating, and reviewing legal documents.
- Ability to communicate and interact effectively, including persuading and influencing leaders across teams.
- Strong analytical and problem-solving skills.
- Ability to work independently and collaboratively in a fast-paced, high-pressure environment.
- High degree of client service, professional ethics, and integrity.
- Three to five years of experience practicing law with a focus on healthcare law.
Responsibilities
- Provide legal services for the MUHA hospitals and affiliates in coordination with the General Counsel for MUSC Health.
- Assist in protecting the organization's legal interests and maintaining operations within the scope established by law.
- Provide hands-on counsel to executive staff and manage legal department operations.
- Identify and analyze legal issues, draft key documents, present recommendations to top management, and ensure legal compliance.
- Manage attorneys in legal specializations such as tax, litigation, acquisitions, and intellectual property, as needed.
- Prepare new contracts and review existing or proposed contracts and vendor arrangements using the electronic contract management system.
- Draft, negotiate, and review legal, services, consultant, and employment contracts.
- Work collaboratively with the Director of Managed Care on hospital payor agreements.
- Interpret or obtain interpretations of federal and state laws affecting the Authority.
- Provide complex analysis of federal and state healthcare laws and regulations.
- Apply Authority bylaws, policies, and procedures, including fraud and abuse laws, Medicare and Medicaid Conditions of Participation, coverage and reimbursement requirements, 340B requirements, HIPAA and privacy requirements, EMTALA, Joint Commission standards, and applicable state regulations.
- Establish working relationships with relevant agencies, including South Carolina health, human services, and labor, licensing, and regulation authorities.
- Assist management with clinical and patient care issues.
- Evaluate patient and family social issues and provide timely advice regarding consents, involuntary commitments, guardianships, guardian ad litem matters, and probate matters.
- Participate in legal and administrative proceedings concerning the Authority.
- Serve as an agent for accepting, reviewing, and notifying employees about subpoenas, depositions, and hearings.
- Coordinate depositions and produce required records and documents.
- Provide guidance on a wide range of legal and regulatory issues as a member of the MUSC Office of General Counsel.
