Requirements
  • A Law Clerk designation from an Ontario post-secondary institution is required.
  • A minimum of 5–10 years of experience as a real estate law clerk in a firm and/or title insurance environment is required.
  • Strong knowledge of the Ontario Land Titles System and its terminology is required; knowledge of land-title systems across Canada is an asset.
  • The ability to read and understand Ontario title searches and identify title defects is required; experience with title searches across Canada is an asset.
  • Familiarity with building and zoning regulations and land-use laws affecting real estate transactions is required.
  • The ability to read and understand surveys is required.
  • The ability to interpret and apply legal principles and decisions to specific real estate issues, claims, and transactions is required.
  • Strong negotiation skills and the ability to make difficult decisions confidently are required.
  • Strong analytical skills are required, including the ability to investigate, collect, organize, analyze, and disseminate significant amounts of information with extreme attention to detail.
  • Effective oral and written customer communication skills are required, including the ability to deliver a superior customer-service experience in adverse circumstances.
  • The ability to work under pressure, manage multiple files in parallel, and meet deadlines is required.
  • The ability to work independently and collaboratively is required.
  • The ability to prioritize tasks and remain highly organized is required.
  • Proficiency in Microsoft Office, including Word, Excel, and Outlook, is required.
  • The role requires daily use of the corporate claims-file-management and finance-software platform.
Responsibilities
  • Investigate, assess, and manage claims made under title-insurance policies, including claims involving title defects, survey issues, building matters, and zoning matters.
  • Communicate available coverage under the applicable policies to property owners, lawyers, lenders, and internal business partners, and identify applicable coverage exceptions and exclusions.
  • Determine and communicate claim-resolution options and retain and instruct third-party experts such as outside counsel, adjusters, and appraisers.
  • Negotiate settlements and release provisions and review files for potential recovery.
  • Review and authenticate new title claims across Canada, excluding Quebec, for accuracy.
  • Initiate contact with claimants within required timelines to meet service levels.
  • Determine and communicate next steps by applying provincial and territorial knowledge and identifying the applicable coverage area for each claim.
  • Retain and instruct external professionals, including adjusters, lawyers, surveyors, appraisers, and contractors.
  • Manage the service levels of retained third parties to align with FCT service levels.
  • Correspond and communicate with customers regarding decisions, timelines, and policy options.
  • Analyze third-party reports, including legal opinions, surveys, and appraisals, for accuracy, coverage determination, and claim-resolution next steps.
  • Communicate denied claims to internal business partners and external parties as required.
  • Manage escalations and disputes concerning coverage positions.
  • Identify potential business concerns related to coverage positions and escalate them as needed.
  • Determine, set, and maintain settlement and expense reserves.
  • Post financial transactions as required.
  • Follow standard internal guidelines and processes for file management.
