Caesars uses Seminole Tribe's argument for lawsuit dismissal against New York tribe. Caesars claims servers are not on tribal land. Caesars Entertainment has moved for a dismissal of a federal lawsuit brought by a New York tribe over offering mobile sports betting on tribal land. However, they're using the same argument crafted by the Seminole Tribe of Florida to do it. The Cayuga Nation Tribe claims the company is violating the Indian Gaming Regulatory Act (IGRA). Caesars has moved to have the suit thrown out, citing a previous federal ruling in Florida. That ruling dictated that betting occurs where a gaming entity's servers are located. Florida had granted the Seminole Tribe exclusive license to operate mobile sports betting throughout the state. A casino operator sued. The court ruled the tribe could serve the entire state as long as its servers were on tribal property. Caesars is now making a similar argument in New York. The company argues that bets made anywhere in the state, including on tribal lands, is legal because its servers are on its properties. The company also claims that New York took that stance when it legalized sports betting. "If the Nation is correct that New York's framework is inconsistent with IGRA, then its dispute is with New York and its regulators," Caesars said in the motion for dismissal. Tribal lands now geofenced. Beyond the regulatory framework, Caesars argues federal tribal gaming law doesn't allow a tribe to sue a private sportsbook under this type of issue. The IGRA does, in fact, allow some legal action against private operators. Caesars claims, however, the tribe doesn't have standing for the suit because it lacks a Class III gaming license. After receiving a cease-and-desist letter from the tribe in 2025, Caesars geofenced Cayuga National lands. However, it ignored the tribe's attempts to obtain information on wagers made on the reservation. Cayuga has until Sept. 22 to respond. Caesars would then have until Sept. 29 to reply. The tribe has a similar legal action against the state over online lottery sales on its land. Legal expert believes tribe has A case. In June, Nova Southeastern University law professor Bob Jarvis told Card Player the Cayuga lawsuit may have merit. "In previous cases, courts have made it clear that what is important is where the bet is placed, not where it is accepted," Jarvis said. "This, of course, was how the United States was able to stop U.S. bettors from being able to bet on overseas gambling websites." Jarvis argues that under federal law, tribes are sovereign. He said this gives them the right to prohibit gambling on their lands. "And even if they place their own gambling enterprises on their land, the result is the same because courts have made it clear that the sovereign does not have to provide equal opportunities when it comes to gambling, as opposed to other types of activities, where the sovereign must provide such equal opportunities to all competitors," he said. "The reason why the sovereign can discriminate when it comes to gambling, of course, is because gambling is considered a vice, and therefore the sovereign is free to regulate it as it wishes." While Caesars is making moves in New York, the company is now considering a buyout from Golden Nugget owner Tilman Fertitta's company.

It is now available to New Jersey online casino players. The title can currently be accessed through three Caesars platforms: Caesars Palace Online Casino, Caesars Sportsbook & Casino, and Horseshoe Online Casino. Players have the option of using the iOS or Android version of each platform. Access through a desktop computer is also available. New Jersey is the first state in which Caesars has introduced Ball Rush Jackpots. The company has indicated in its launch announcement that it intends to make the game available in additional states. How Ball Rush Jackpots works. Caesars describes Ball Rush Jackpots as an arcade- and Plinko-style game played on a pyramid-shaped board filled with pegs. After one or more balls are released from the top, each ball follows an independent path through the board before reaching a prize or multiplier slot at the bottom. The available wagering range extends from $0.10 to $250. Before each round begins, players are able to select the price of each ball, the number of balls they want to release, and a board configuration containing between 11 and 14 rows of pegs. Players who prefer to move through the ball-drop sequence more quickly have the option of using the Fast Forward function. Pressing and holding the control temporarily increases the speed at which the sequence is displayed. Caesars has not made the game's return-to-player percentage or volatility publicly available. The complete pay table, prize structure, and wagering rules can be reviewed through the information screen located within the game. How the Re-drop and Jackpot Drop bonuses work. As part of the Re-Drop Bonus, collected balls are sent back onto the board for an additional drop. While that feature is active, the returning balls can pass through multiplier gates carrying values of up to 8x before reaching their final prize slots. The Jackpot Drop Bonus can be activated after players have collected jackpot balls. Once the feature has begun, every ball included in the bonus is guaranteed to land in one of the available jackpot buckets. Five separate jackpot levels are available within Ball Rush Jackpots: Mini, Minor, Major, Mega and Grand. Empire Creative adds a new format to Caesars' lineup. Ball Rush Jackpots is a proprietary title developed by Empire Creative. The company serves as the internal game development studio for Caesars. The game is available exclusively through Caesars' online casino brands. The existing proprietary lineup from Caesars also includes Ca$hline. It was released earlier in 2026. There's also its Signature series of online table games. That collection is made up of Signature Blackjack, Signature American Roulette, and Signature Baccarat. Gross operating profit, however, declined 10.1% to $164.9 million. The results continued a pattern seen earlier in the year, when revenue remained relatively stable while profits weakened. Industry figures showed that expenses related to labor, goods, services, and online operations placed additional pressure on casino earnings. James Plousis, chair of the New Jersey Casino Control Commission, said casinos faced their highest second-quarter costs and expenses in nine years. "The casino hotels encountered their highest second-quarter costs and expenses in nine years, significantly constraining reported gross operating profits," Plousis said. Borgata maintains profit leadership. As published in New Jersey Division of Gaming Enforcement (DGE)'s release (pdf), Borgata Hotel Casino & Spa remained the most profitable casino in Atlantic City during the second quarter, generating $60.1 million in gross operating profit. The figure represented a 4.7% decline from the previous year, while revenue increased 3.6% to $218.4 million. Ocean Casino Resort recorded the strongest profit growth among the major properties, with gross operating profit rising 12.2% to $30.1 million. Its revenue increased 9.2% to $142 million. Hard Rock Hotel & Casino Atlantic City reported $29.1 million in profit, down 10.5%, while revenue decreased slightly to $148.4 million. Caesars Atlantic City was another property to post higher earnings, with profit increasing 2.9% to approximately $13 million and revenue rising 7.7% to $68.1 million. The remaining casinos reported lower quarterly profits. Tropicana Atlantic City's profit fell 8.7% to $13.6 million, Harrah's Atlantic City declined 6.8% to $11.1 million, and Bally's Atlantic City dropped 8.8% to $2.1 million. Golden Nugget Atlantic City recorded a 43% profit decline to $2.9 million, while Resorts Casino Hotel experienced the largest reduction, with profit falling 95.2% to $473,000. Resorts attributed much of the decline to a deferred revenue payment from PokerStars in the previous year that was not repeated after the partnership ended. Revenue growth fails to offset rising costs. During the first half of 2026, Atlantic City casinos generated $1.57 billion in net revenue, a 0.2% increase year over year. Gross operating profit dropped 15.5% to $269.6 million, leaving the market approximately $49.6 million below the previous year's profit total. The industry's profit margin also narrowed from 20.4% to around 17.2%. Borgata remained the first-half profit leader with $99.9 million, although that represented a 10.2% decrease. Hard Rock and Ocean followed with approximately $48.9 million each, together accounting for most of the market's first-half earnings. Caesars improved its first-half profit by 11.1% to $17.9 million, while Bally's moved from a loss of $896,000 in the first half of 2025 to a $1.3 million profit in 2026. Brian Tyrrell, director of Stockton University's Lloyd D. Levenson Institute of Gaming, Hospitality and Tourism, said the figures reflected a broader profitability challenge. "Even allowing for seasonal variation, there appears to be a clear trend in declining gross operating profit, even as the relatively mature integrated casino resort market in Atlantic City has produced steady net earnings year-over-year," Tyrrell said. He also noted that higher costs for goods, labor, internet operations, and sports betting contributed to the pressure on casino margins. "Revenue at Atlantic City casinos does not always translate to profitability," Tyrrell said. Hotel demand remains stable. Despite weaker profits, casino hotels continued to attract visitors during the first half of 2026. Second-quarter hotel occupancy reached 73.2%, up 0.6 percentage points from the previous year. The average room rate was $171.71. Ocean Casino Resort reported the highest occupancy rate at 87.1% and the highest average room rate at $269.24. Hard Rock followed with 86.4% occupancy, while Caesars reached 82.2%. Across the first six months of the year, casino hotel occupancy increased to 69%, compared with 67.8% during the same period in 2025. "All casino hotels were profitable in the second quarter, with two reporting higher profits compared to the same period last year. Stable net revenue and hotel occupancy demonstrate the casinos continue to compete well for gaming and leisure tourists," Plousis said. Atlantic City's casino market faces additional changes ahead, including competition from planned New York City casinos and possible ownership changes among existing operators. A potential acquisition of Caesars Entertainment by Golden Nugget owner Tilman Fertitta could alter the city's ownership structure. If completed, the transaction could result in Fertitta's company controlling four of Atlantic City's nine casinos, requiring regulators to review whether the arrangement creates concerns under New Jersey's economic concentration rules.

The investigation into Caesars Sportsbook first began on August 5, 2026, as a result of which the regulator identified the violations and imposed the biggest penalty that the NJDGE has ever issued. Previously, New Jersey had fined operators $40,000 and $100,000, and the biggest reported penalty was $112,188, which was imposed on Super Group, Betway, and Jackpot City. The NJDGE shared in a statement: "It is hereby ordered that the Action in Lieu of Complaint dated August 5, 2026 and issued by the Division of Gaming Enforcement to Caesars Sportsbook regarding responsible gaming matters concerning non-compliance with N.J.A.C. 13:69C-14.2(b)...is hereby adopted." The stricter enforcement action is part of a broader trend in the United States, with gambling regulators in states like Ohio having issued penalties reaching $150,000 and $250,000 on operators including Barstool Sportsbook, Caesars, DraftKings, and BetMGM. At the same time, the measure against Caesars Sportsbook isn't the only one during the last year, as the operator was hit with a $10,000 fine in Massachusetts and an additional $7.8 million proposed penalty in Nevada.

For his part, Resorts President Mark Giannantonio attributed his casino's profit decline largely to a deferred revenue payment from PokerStars in 2025 that was not repeated this year after their contract ended in 2025. New Jersey Casino Control Commission Chairman James Plousis said the casinos faced their highest second-quarter costs and expenses in nine years. Despite the decline in profits, he said stable net revenue and hotel occupancy showed that the casinos continued to compete for gaming and leisure tourists. Ocean recorded the highest hotel occupancy at 87.1%, while Golden Nugget had the lowest at 53%. Ocean also posted the highest average nightly room rate at $269.24, compared with $109.96 at Golden Nugget. A pending sale of Caesars Entertainment to Golden Nugget owner Tilman Fertitta could affect Atlantic City's market. If completed, the deal would give Fertitta's company ownership of four of the city's nine casinos. New Jersey regulators would then have to assess whether the ownership structure violates the state's law against undue economic concentration. Potential measures could include requiring the sale or closure of one or more casinos.
