280 corridor business happenings: september 2026. Sep. 01, 2026 midnight PopUp Bagels PopUp Bagels, at 329 Summit Blvd., opened in July at The Summit. It's the first location for the company in the state. Founded in Westport, Connecticut, PopUp Bagels serves bagels fresh out of the oven hot and whole. Customers can choose from bagel flavors like plain, everything, poppy seed, salt and sesame with a variety of butter and cream cheese flavors. PopUp Bagels is open Monday through Thursday from 7 a.m. to 3 p.m. and Friday through Sunday 7 a.m. to 4 p.m. Brandy Melville Brandy Melville opened in August at 209 Summit Blvd., Suite 100, at The Summit. With a California-inspired aesthetic, they offer youth apparel and accessories for girls including pajamas, cardigans, clothing, jewelry, bags, hats, tops, bottoms and more. Brandy Melville is open Monday through Saturday from 10 a.m. to 9 p.m. and Sunday 12 to 6 p.m. COMING SOON Aritzia, a fashion design house, will open its first Alabama location at the Summit near The Cheesecake Factory. Originally started in a department store in Vancouver, Canada, the boutique now offers a variety of women's clothes and accessories including dresses, activewear, sweatfleece, shoes, hats, belts and more. Aritzia said it will open this summer, but no official date has been announced for the opening of the 7,670-square-foot store. British clothing brand Boden is planning to open its third U.S. location at the Summit this fall. The 35-year-old company first brought its bold prints and bright colors to the United States in 2002 and currently has locations in Alpharetta, Georgia, and and Nashville. The brand offers a variety of women's, children's and baby apparel and will be at 200 Summit Blvd. Saw's BBQ is bringing its signature barbecue, sandwiches and sides to Valley Post in Chelsea at 1004 Dunnavant Valley Road. The new location is scheduled to open this fall. Founded in 2009 in Homewood, the restaurant has now expanded and become one of the state's best-known barbecue brands. Saw's also has locations in Avondale, Crestline, Hoover, Leeds and Southside, along with its food truck. The restaurant posted that customers can enjoy all of the smoke, charm and southern flair that they have come to expect from the brand at the new location. Dogtopia is planning to open a location at 5361 U.S. 280 in the Bazaar 280 shopping center. The dog daycare, boarding and spa franchise will be operated by Henson and Carlton Millsap. They also own Dogtopia locations in Birmingham and Homewood. The indoor facility will offer overnight boarding, spa services and daycare. Dogtopia has more than 285 locations across the country. An opening date has not been set yet. Target will be coming to Chelsea as the anchor store in The Shoppes at Chelsea, which is a new 20-acre retail development at the corner of Chelsea Corners Way and Shelby County Road 47 off U.S. 280. GBT Realty Corp. acquired the 20.46-acre site for the planned development and sold 11.23 acres to Target. The Shoppes at Chelsea will feature 34,300 square feet of retail space, two outparcels and the 128,667-square-foot Target store. The development is set to open in either late 2027 or early 2028, but no groundbreaking date has been announced. Waldo's Chicken and Beer Waldo's Chicken and Beer will be opening a new location at Valley Post in Chelsea this fall to serve up their made-from-scratch dishes, sauces and chicken served either Southern fried or rotisserie. They hand-cut and brine their chicken overnight, and they don't have a freezer in the restaurant because everything is made from scratch each day. With Alabama locations in Cahaba Heights, Dothan, Auburn, Vestavia Hills and Pelham, the restaurant is in 10 states. NEWS AND ACCOMPLISHMENTS Capstone Building Corp., a general contractor headquartered at 1200 Corporate Drive, Suite 350, has projects in both Orlando and Atlanta. They recently began construction on The Gateway, a luxury multifamily apartment development minutes from Orlando International Airport. The Gateway will encompass more than 417,000 square feet and feature 270 luxury apartment homes. The anticipated completion is in late 2027. Capstone also recently completed Herndon Square Phase II, a $57 million multifamily housing development in Atlanta. The project spans 335,348 square feet and includes a six-story residential building with 201 apartment homes. The project represents the second phase of the transformative Herndon Square redevelopment on Atlanta's Westside. Founders Matthew and Lauren Zauchin created the pharmacy to provide personalized patient health care with an upscale small-town feel, focused on a modern approach to health and wellness. Canadian retailer Roots to go private in $160 million deal. Iconic Canadian retailer Roots (TSE: ROOT) has agreed to be taken private in a deal valued at $160.72 million. Marketing company Marquee Brands will take Roots private at a price of $4.10 per share, which represents an 11% premium to the $3.69 closing price of the retailer's stock on Aug. 20. Under terms of the deal, Marquee Brands and its partners will acquire all of Roots' 39.2 million outstanding common shares. The go-private deal is expected to be finalized by year's end subject to regulatory approvals and a shareholder vote in October. For Roots, going private ends a long slow decline for the company as a publicly traded entity. Roots has struggled for years with declining sales and a slumping stock price, leading management to announce this March that they were undertaking a strategic review. In June of this year, Roots reported a net loss of -$10.1 million, equivalent to a loss of -$0.26 per share. That was worse than a net loss of -$7.9 million, or -$0.20 a share, a year earlier. Roots has faced growing competition and lost ground with younger consumers to trendier clothing brands such as Aritzia (TSE: ATZ) and Abercrombie & Fitch (ANF). Consequently, Roots' share price has steadily eroded. After peaking at $13.53 a share in 2018, the stock has declined 73% to close at $3.69 per share on Aug. 20 of this year. Trading under $5 a share made Roots a penny stock and the company's market capitalization of $143.70 million made it a micro-cap security.
Aritzia opens first Gulf Coast store at Lakeside. The new store opened August 13 in the main mall, according to Lakeside Shopping Center. It is Aritzia's first location in the Gulf Coast region. Aritzia sells women's apparel and accessories through a portfolio of in-house brands, including Wilfred, Babaton, TNA, Golden by TNA, Sunday Best and The Group by Babaton. The Metairie store also offers personalized styling services. "We are thrilled to welcome Aritzia to Lakeside Shopping Center and celebrate the opening of its first Gulf Coast location," Lakeside Shopping Center General Manager Lisa Manzella said. "Introducing a brand of Aritzia's caliber reflects our ongoing commitment to bringing highly sought-after retailers and exceptional experiences to our shoppers. This opening further strengthens Lakeside's position as the Gulf South's premier fashion destination." Lakeside is marking the opening with promotions during the store's first weekend. The mall also installed a 10-foot-tall Aritzia shopping bag display in Center Court that will remain through Aug. 25. The opening continues an expansion of Lakeside's fashion and apparel offerings. The shopping center recently announced that athletic footwear and apparel retailer JD Sports plans to open a location in the Macy's wing in late 2026. Lakeside Shopping Center, at 3301 Veterans Memorial Blvd., has operated for more than 65 years and encompasses more than 1.2 million square feet of retail space. The mall has more than 100 stores and is anchored by Dillard's, Macy's and JCPenney.
Federal Court grants 'solicitor's eyes only' order in fashion brand trademark infringement suit. Order covers confidential commercial data Jul 24, 2026 / Share In a proceeding alleging trademark infringement against Aritzia Inc. and Aritzia LP, the Federal Court issued a "solicitor's eyes only" (SEO) order over product-level confidential information dubbed Aritzia's "special sauce" by the company's senior vice president and corporate controller. Northern Reflections Ltd. v. Aritzia Inc., 2026 CanLII 71256 (FC), arose from Northern Reflections Ltd.'s claim that Aritzia infringed its registered trademark for EFFORTLESS, in association with pants and shorts, by selling pants and shorts branded as "EFFORTLESS" or "THE EFFORTLESS PANT". Aritzia moved for a protective order over some documents and information that the parties would exchange during the discovery phase. The parties agreed to the issuance of such an order. However, a dispute arose regarding Aritzia's request for an SEO designation, which would prevent Northern Reflections from accessing certain confidential information produced by Aritzia if Aritzia believed in good faith that the information: * contained "sales, marketing, financial or other commercially sensitive information or proprietary information not otherwise known or available to the public..." * had commercial value to Northern Reflections * could harm Aritzia if available to Northern Reflections SEO order granted. The Federal Court ruled that Aritzia met the test for the grant of a protective order with an SEO designation. Regarding the first part of the test in AB Hassle v. Canada (Minister of National Health and Welfare), 1998 CanLII 8942 (FCTTD), the court found that Aritzia protected the sensitive information's confidentiality at all relevant times and by various mechanisms. Regarding the second component of the AB Hassle test, the court determined that this case involved "unusual circumstances" warranting an SEO order. The court added that the SEO order's built-in mechanisms would mitigate any concerns about the order's impact on solicitor-client relations. The court explained that counsel could challenge the designation of information if they deemed it necessary to disclose certain documents to their clients. Whether parties were competitors. The Federal Court left it to the trial judge in the underlying trademark infringement action to determine on a final basis the factual issue of whether the parties were competitors. However, the court said the following findings, based on the limited record, favoured issuing an SEO order: * The parties operated in the same industry * Northern Reflections claimed to be Aritzia's competitor in this litigation * Northern Reflections was at least an aspiring or would-be competitor Sensitivity and value of information. The Federal Court's decision recognized the highly sensitive nature of the information that would be subject to the SEO order - specifically, product-level data on sales and product costs, manufacturing costs, and gross profit margins for 33 products in Aritzia's EFFORTLESS product line. The court acknowledged that the product-level confidential information would have substantial value to Northern Reflections and other would-be competitors within the highly competitive women's fashion industry. On the balance of probabilities, the court saw a real and substantial threat that giving access to the valuable commercial information could enable a potential competitor like Northern Reflections to copy Aritzia's costing and sales structures, thus seriously harming Aritzia's market share and financial position. The court added that granting access to the commercial data could enable Northern Reflections' management team members, some of whom supported or served in roles at other women's fashion brands or companies under the same ownership, to unwittingly and unintentionally misuse the information in future business matters. Costs order. Pursuant to the parties' request, the Federal Court awarded Aritzia, as the successful party on the motion, $5,500 in lump sum costs, plus reasonable disbursements.
