Liquidia stock plunges 59% in a month after patent ruling; how much further could it fall?

Liquidia shares have fallen 59% over the past month, while the S&P 500 gained 2.5%. The stock dropped nearly 50% on September 30 after a federal judge ruled that its inhaled lung drug Yutrepia infringes a United Therapeutics patent. Since 2018, the stock has fallen an average of 28.7% in seven market shocks, against 17.1% for the S&P 500. It recovered to its pre-shock high after each one. Liquidia, United Therapeutics reach $381 million deal to end lung drug litigation. By CPI | October 14, 2026 Liquidia has agreed to pay approximately $380.7 million to United Therapeutics and other parties to resolve a yearslong legal conflict over its lung disease treatment Yutrepia, ending six lawsuits involving patent infringement, trade secrets, contractual disputes and antitrust allegations. The settlement, announced Tuesday, allows Liquidia to continue selling Yutrepia for pulmonary arterial hypertension, or PAH, while requiring the company to stop promoting and commercializing the treatment for pulmonary hypertension associated with interstitial lung disease, known as PH-ILD, according to Reuters and company disclosures. The agreement marks the conclusion of a prolonged dispute between two competing developers of treprostinil-based treatments. Liquidia's Yutrepia is a dry-powder inhaled formulation of the drug, while United Therapeutics markets the competing Tyvaso franchise. Under the financial terms disclosed by Liquidia, the company will make an initial net payment of $175 million to United Therapeutics within 30 business days. Two additional installments of $72.7 million each are scheduled for January 31 and April 30, 2027. Liquidia will separately pay $60.3 million in October to parties holding interests in related antitrust litigation involving Treprostinil Injection. Together, the payments represent the approximately $380.7 million settlement cost. Deal follows Delaware patent ruling. The settlement comes two weeks after a federal court in Delaware ruled against Liquidia in a patent dispute concerning Yutrepia's use for PH-ILD. On September 30, the court found that two claims of United Therapeutics' U.S. Patent No. 11,826,327 were valid and infringed by Liquidia. The patent covers methods of treating PH-ILD with inhaled treprostinil, including dry-powder formulations. As part of the settlement, Liquidia agreed not to appeal the decision and submitted a request to the U.S. Food and Drug Administration to remove the PH-ILD indication from Yutrepia's approved labeling. The company also agreed to discontinue clinical trial cohorts investigating Yutrepia for PH-ILD and stop publication of related study data, according to a United Therapeutics regulatory filing cited by Reuters. The settlement includes mutual legal releases and does not constitute an admission of liability by either company. Following the initial payment, the companies are expected to file documents formally dismissing the pending litigation with prejudice, preventing those claims from being brought again between the parties. The six proceedings span patent infringement allegations, claims involving the alleged misuse of trade secrets, contractual disputes and antitrust litigation concerning treprostinil products. Yutrepia retains access to key treatment market. The commercial provisions are central to the agreement because they preserve Liquidia's ability to compete in PAH, even as the company relinquishes its position in PH-ILD. PAH is a progressive disorder involving elevated blood pressure in the pulmonary arteries. PH-ILD, by contrast, develops in association with lung diseases that cause inflammation and scarring. Yutrepia will remain available for PAH patients without interruption, Liquidia said. The company will also continue developing its broader clinical portfolio, including L606, an experimental extended-release treprostinil treatment being studied for PAH and PH-ILD. For United Therapeutics, the restrictions on Yutrepia reduce competition for Tyvaso in the PH-ILD market. Jefferies analyst Roger Song said the agreement could improve visibility into the future growth of the Tyvaso franchise, according to Reuters. Liquidia plans to fund payments through existing operations. Liquidia said it expects to finance the settlement through existing cash holdings and ongoing Yutrepia sales rather than seek additional capital. The company reported preliminary, unaudited Yutrepia net product sales of $222.7 million for the third quarter of 2026 and cash and cash equivalents of $396.1 million as of September 30. Chief Operating Officer and Chief Financial Officer Michael Kaseta said the company expects to meet its settlement obligations while continuing to invest in its commercial operations and clinical programs. Liquidia also terminated a promotional agreement involving Treprostinil Injection and will cease commercial support for that product as part of the broader resolution of the antitrust-related matters. The agreement drew a positive response from analysts, who viewed the removal of legal uncertainty as significant for Liquidia's commercial outlook. JPMorgan analyst Jessica Fye said the financial payment was more favorable to United Therapeutics than expected, according to Reuters. Liquidia shares rose nearly 37% in premarket trading Wednesday after losing more than half their value following the September court decision.

United lands 'clear-cut win' as Liquidia agrees to $380M settlement in Tyvaso patent infringement saga. With a years-long patent dispute between the two drugmakers finally put to bed - complete with a hefty settlement payout - United Therapeutics has clinched what one analyst calls a "clear-cut win" over lung disease rival Liquidia Technologies. As first communicated in late September, the U.S. District Court for the District of Delaware has found that Liquidia infringed two claims of a United Therapeutics patent related to its inhaled treprostinil drug Tyvaso. The decision specifically concerns Tyvaso in pulmonary hypertension associated with interstitial lung disease (PH-ILD), with the alleged patent violations on Liquidia's part revolving around its rival treprostinil medicine Yutrepia. Despite United Therapeutics bringing its latest lawsuit to bear against Liquidia in February 2024, Yutrepia ultimately won formal FDA sign-off in PH-ILD, as well as pulmonary arterial hypertension (PAH), last May. Under the terms of the settlement unveiled this week, Liquidia will pay out a little over $380 million to United Therapeutics in installments through 2026 and 2027, which it said Wednesday will be "inclusive of payments to resolve antitrust litigation against United Therapeutics." Crucially, Liquidia has also agreed to "immediately" work with the FDA to remove the PH-ILD indication from Yutrepia's label, according to a United Therapeutics securities filing. "Going forward, Liquidia agrees that it will only market, detail, and promote Yutrepia to health care practitioners who, to Liquidia's knowledge, treat patients with pulmonary arterial hypertension," United Therapeutics said. Liquidia, for its part, said in an Oct. 14 release that it won't appeal the court's ruling and framed the resolution as a positive overall, given that it ensures Yutrepia will remain on tap for patients with PAH. According to Liquidia's communique, Yutrepia generated $222.7 million in preliminary third-quarter sales, which had helped build out some $396 million in cash reserves at the company as of Sept. 30. Liquidia clarified it will continue to advance its Yutrepia post-marketing studies, as well as those for L606, a next-generation sustained-release liposomal formulation of treprostinil being aimed at both PAH and PH-ILD. The settlement "resolves all pending litigation between the companies," Liquidia added in its release. The company will look to the settlement as something of a clean slate, with CEO Roger Jeffs noting in a statement Wednesday that the company can focus its "full attention and resources on further growing the Yutrepia brand, with the goal of making it the prostacyclin therapy of choice in PAH." United Therapeutics launched its latest legal challenge against Liquidia in early 2024 after facing a setback at the federal appeals court, where it had at the time failed to resurrect an invalidated patent on Tyvaso. The company's lawsuit took aim at the FDA and Liquidia, asserting that the U.S. regulator had let Liquidia sidestep "rules, precedents and procedures" when amending its pending new drug application for a potential PH-ILD indication. United Therapeutics had argued this additional niche should have been pursued in a separate Yutrepia application. In a release late last month, United Therapeutics noted that the court's decision ultimately came down to Liquidia's violations of two claims related to its so-called '327 patent, which covers a method of "improving exercise capacity in patients with PH-ILD by inhaling treprostinil at specific dosages." The court further determined that Liquidia had failed to prove those intellectual property claims were invalid. "We view the outcome as a clear win" for United Therapeutics, analysts at Jefferies remarked on the settlement in a Wednesday note to clients. The resolution clears up line-of-sight for Tyvaso growth in PH-ILD and also lets investors refocus on other emerging opportunities in United Therapeutics' pipeline, they said. With two phase 3 wins under its belt, United Therapeutics is eyeing Tyvaso's next opportunity in idiopathic pulmonary fibrosis, where Jefferies previously flagged a whopping $5 billion to $10 billion opportunity for Tyvaso as a potential new standard of care in the lung scarring disease, estimated to effect over 100,000 people in the U.S. Meanwhile, the settlement also serves to remove a "major overhang that has weighed on both stocks," the Jefferies team said. The broader litigation saga originally dates back to the summer of 2020, several months after Liquidia initially filed its Yutrepia application with the FDA. United Therapeutics' share price was trading down near 0.6% heading into mid-morning Wednesday, while Liquidia enjoyed a major 37.6% bump to its stock.

Liquidia shares fall 57% after court rules Yutrepia infringed patents; investors probed

Law firm Levi & Korsinsky is investigating whether Liquidia Corporation (NASDAQ: LQDA) gave investors an accurate picture of its patent litigation risk. The company's shares fell roughly 57% after a court found that its product Yutrepia infringed two valid claims of United Therapeutics' '327 patent. United Therapeutics has sought an injunction. Chief executive officer Roger Jeffs said Liquidia disagrees with the decision and will pursue appellate options. In its Form 10-Q filed August 12, 2026, Liquidia reported $300.3 million in Yutrepia sales for the first six months of 2026. The filing also listed about $69.1 million in non-cancelable manufacturing and supply commitments. The firm says investors who bought Liquidia shares and lost money may be eligible to seek compensation, even if they have sold.
