Requirements
  • J.D. degree and a state bar member in good standing
  • 7+ years of experience, preferably with some in-house experience
  • Familiarity and experience with consumer finance, consumer protection, payments, banking and additional FinTech related matters, including the laws, rules and regulations applicable to banks, bank partners, and/or the participants in the payments ecosystem, including processors and program managers
  • Excellent organization and project management skills, and the ability to independently prioritize multiple simultaneous projects with different deadlines
  • Sound and practical business judgment, intellectual creativity, and problem-solving skills
  • Ability to develop positive relationships with internal and external partners, including senior company executives and external stakeholders
Responsibilities
  • Be a trusted advisor to Empower's CEO, Board of Directors, and senior business executives by providing timely, concise, and business-focused legal advice on federal and state consumer finance, consumer protection, payments, and banking laws, rules and regulations
  • Provide counsel on the business and legal ramifications of material company strategic initiatives, including potential M&A activity, fundraising, bank partnership arrangements, and critical vendor agreements
  • Monitor exposure arising from potential or actual litigation
  • Oversee Empower's state licensing strategy and develop and implement an appropriate state licensing program
  • Oversee relationships with external legal resources to effectively manage legal expenses and legal exposure
  • Provide legal counsel and guidance to Compliance on matters of regulatory compliance
  • Provide guidance to our Product and Engineering teams as a partner in order to successfully launch compelling products and services
  • Partner with and support our Marketing and Design teams, advising on marketing collateral and product claims
  • Partner with and support our Finance and Operations team negotiation, drafting, and advising on vendor contracts and advising on certain HR-related matters
  • Where appropriate, engage with regulatory agencies and supervisory authorities
  • Maintain knowledge of organization's operations and legal documents
  • Draft terms of use, product policies, and disclosures
  • Remain up-to-date on relevant industry, consumer protection, and advertising laws and regulations to ensure an ongoing ability to provide sound advice
  • Develop strong, collaborative relationships with internal stakeholders
