Requirements
  • At least 5 years of experience in legal operations, compliance management, or collections oversight within consumer lending, auto finance, or a third-party collection agency.
  • A demonstrably stable career history.
  • Experience in non-prime or subprime auto lending.
  • Working knowledge of the Fair Debt Collection Practices Act, Unfair, Deceptive, or Abusive Acts or Practices, and applicable state consumer protection laws as they apply to post-charge-off collections.
  • Experience managing bankruptcy filings across a consumer lending portfolio and handling Servicemembers Civil Relief Act compliance for servicemember accounts.
  • Experience managing outside counsel relationships, including scoping work, reviewing billing, holding counsel accountable to timelines, and escalating inadequate representation.
  • Experience working in or alongside a deficiency recovery operation, including settlement letters, agency placement, and legal escalation.
  • Ability to interpret collections performance data independently.
  • A bachelor's degree.
  • The role is not a practicing attorney position; outside counsel handles legal action.
Responsibilities
  • Design and own qualification criteria for legal escalation of accounts with deficiency balances, maintain the controlled file, audit routing, and approve threshold changes.
  • Monitor the legal escalation pipeline, review exceptions, and maintain the compliance log.
  • Review and approve settlement letter content for compliance with Fair Debt Collection Practices Act requirements and applicable state law.
  • Review and approve deficiency collection contact scripts and settlement authority structures, including material changes.
  • Own legal and compliance reporting within the collections key performance indicator package, prepare quarterly Board updates, and promptly escalate material issues.
  • Complete Fair Debt Collection Practices Act and Unfair, Deceptive, or Abusive Acts or Practices reviews of consumer-facing components and maintain reviews as regulations change.
  • Build and maintain a state-by-state legal viability map for deficiency collections and communicate updates.
  • Ensure deficiency collection approaches are based on loan attributes and document the Equal Credit Opportunity Act compliance basis for differentiated treatment.
  • Manage bankruptcy filings across the portfolio.
  • Ensure Servicemembers Civil Relief Act compliance for servicemember accounts.
  • Coordinate responses to Consumer Financial Protection Bureau inquiries, state attorney general matters, and regulatory consumer complaints.
  • Build and deliver compliance training for post-charge-off staff.
  • Vet third-party collection agencies, evaluate their compliance posture, call recording infrastructure, data security standards, and relevant experience, and ensure appropriate contract provisions.
  • Own the ongoing agency compliance program, conduct call audits, track complaints, and manage performance monitoring and remediation.
  • Oversee third-party business process outsourcing partners working on post-charge-off accounts.
  • Lead outside counsel evaluation and selection, manage referrals and relationships, monitor case outcomes, and track costs against recovery.
  • Review vendor contracts and confirm required compliance and oversight provisions.
  • Write and maintain policies and procedures for the post-charge-off collections program, version-control documents, and communicate changes before implementation.
  • Manage active collections-related litigation with outside counsel, maintain the litigation log, and report material developments.
  • Identify process gaps that create legal exposure or reduce recovery and implement solutions.
  • Serve as the legal and compliance resource for collection agents, team leads, and directors.
  • Hire and develop direct reports as program volume increases.
Desired Qualifications
  • JD, paralegal certification, or Certified Regulatory Compliance Manager certification.
  • Experience designing, building, or leading a post-charge-off deficiency recovery program from the ground up.
  • Experience managing legal collections activity across multiple states, including state restrictions on wage garnishment, deficiency suits, and post-judgment enforcement.
  • Experience building or administering an agency compliance monitoring program, exercising audit rights, and terminating vendors for compliance failures.
  • Background at a non-prime auto lender or servicer such as Consumer Portfolio Services, Westlake Financial, Exeter Finance, CAC Holdings, DriveTime, First Investors, or a similar organization.
