Requirements
  • A law degree from an accredited law school and admission to the New York State Bar are required.
  • A minimum of nine years of significant personal injury litigation experience is required, including ultimate responsibility for significant numbers of serious matters.
  • Four years of managerial or equivalent supervisory experience are required.
  • Extensive knowledge of local, state, and federal substantive and procedural laws and regulations affecting tort litigation is required.
Responsibilities
  • Directly handle and manage in-house attorneys, legal staff, and outside counsel handling high-volume personal injury and property damage claims through hearings, depositions, discovery, substantive and procedural motion practice, court conferences, settlement negotiations, and trials.
  • Critically analyze personal injury and property damage claims and develop, implement, and oversee litigation assignments and strategies for favorable and cost-effective resolutions consistent with current legal precedent and ethical considerations.
  • Assess liability and damages exposure and make and review reserve and settlement recommendations.
  • Keep senior management informed of high-exposure cases and consult with senior management to develop strategies to reduce tort exposure.
  • Communicate and interact with external departments, including operations and courts.
  • Provide guidance and direction to in-house attorneys and legal staff.
  • Oversee and manage outside counsel.
  • Assist the MTA Legal Department with business goals as required by the General Counsel and Deputy General Counsel for Torts.
  • Perform other duties assigned by senior management.
Desired Qualifications
  • Admission to the United States District Courts for the Eastern and Southern Districts of New York is desirable.
  • Experience defending municipalities, corporate entities, or common carriers is strongly preferred.
  • Experience litigating tort claims involving motor vehicle accidents and premises liability is strongly preferred.
  • Ability to manage and handle a high-volume, varied tort caseload from inception to resolution and work independently and collaboratively under internal or court-imposed time constraints.
  • Prior supervisory experience over professional staff and the ability to exercise sound judgment.
  • Analytical, verbal, writing, and negotiation skills.
  • Ability to build and develop professional relationships with clients, adversaries, and the judiciary.
  • Ability to evaluate, devise, and implement litigation strategies.
  • Ability to forensically analyze medical records and varied technical information.
  • Command of legal research engines, general internet searches, and investigative searches.
  • Proficiency in Microsoft Office Suite or comparable applications, including Word, Excel, PowerPoint, and Outlook.
