Judge bars Ameriprise broker from using Citizens client names recalled from memory.

Judge bars Ameriprise broker from using Citizens client names recalled from memory. by Ali Hibbs October 29, 2026 A federal judge in Boston temporarily barred an Ameriprise Financial advisor from using client names recalled from memory to contact Citizens Securities customers, according to an order on Wednesday. U.S. District Judge Allison Burroughs found that Darrell Smith's recollection of names and subsequent notification to clients of his move to Ameriprise likely violated his employment agreements, according to the order. Citizens had sued Smith and Ameriprise on October 16 accusing them of unfair competition and other claims. The ruling restrains Smith while Citizens will make its case for a permanent injunction and damages in arbitration with the Financial Industry Regulatory Authority. Smith, who had spent 18 years with Citizens before leaving in September, told the court that he had recalled the names of around 150 customers, found their contact information through public sources and contacted some of them to announce his move. Around 111 clients with $120 million in assets had followed Smith to Ameriprise at their own request, according to Smith. Citizens wrote in its petition for the injunction that he had managed around $194 million in assets. Burroughs declined to extend the injunction to cover Ameriprise, which Citizens had named as a defendant. Citizens had acknowledged during a hearing that it had no direct evidence of Ameriprise's involvement in the allegations. It had initially claimed that Ameriprise had assembled a team to help transfer accounts. "These allegations are without merit, and we look forward to presenting our case in arbitration," an Ameriprise spokesperson said in a statement. The firm said it is committed to supporting advisor transitions in a way that complies with legal and regulatory requirements. Burroughs based her ruling on the grounds that Citizens' contracts explicitly banned advisors from announcing their moves to customers and cited prior court rulings that found memorization of a client list constituted removal of confidential information. Smith argued the provision "contradicts industry standards" and that his ethical and fiduciary duties required him to contact clients. Citizens countered that any ethical duties were only owed when giving financial advice, which he did not claim to do on those calls. Burroughs relied on a July ruling by another judge in the same court in Citizens' suit against Scott Coppock, a former advisor who also left for Ameriprise. Ameriprise was not named as a defendant in that case. That court in the Cappock ruling held that under Rhode Island law, which governs both advisors' agreements, a client list committed to memory can still be considered confidential information. While Smith argued that his public-record searches occurred after his resignation, Burroughs said he didn't deny that he learned the names while at Citizens. Citizens' complaint included trade secret claims against both defendants and an unfair competition claim against Ameriprise under a Massachusetts state law that allows up to triple damages for willful or knowing violations. Smith's lawyer and a spokesperson for Citizens did not immediately respond to requests for comment on Thursday. Ameriprise also did not immediately respond. Wells last updated the threshold in 2022 and since then advisor annual revenue has risen 57% on average, according to the firm. Oct 29, 2026 Oct 28, 2026
